Ireland Update - Court of Appeal Overturns High Court Decision on Dismissal of Underperforming Employee During Probation

In a welcome ruling for employers, the Irish Court of Appeal has found that the constitutional right to fair procedures does not apply to the assessment of an employee’s performance by an employer during the probationary period, as this would negate the whole purpose of a probationary period. In this article, we consider the genesis of this decision and its implications for probationary dismissals more generally.
